Copyright Policy

Effective Date: 10/05/2024

This Copyright Policy governs the use of copyrighted materials owned by Ultimate Contractors Corporation (“UCC”) and published on the website ultimatecontractorscorp.com (the “Website”). By accessing or using the Website, you agree to be bound by the terms and conditions of this Copyright Policy.

I. Ownership of Intellectual Property Rights

UCC is the owner or authorized licensee of all copyrights, trademarks, service marks, trade names, logos, and other intellectual property rights (collectively, “Intellectual Property Rights”) associated with the Website and its contents, including but not limited to text, graphics, logos, images, audio, video, software, and databases (collectively, the “Content”).

The Content is protected by United States and international copyright laws and treaties, as well as other applicable intellectual property laws and regulations. Except as expressly permitted under this Copyright Policy or by applicable law, you may not reproduce, distribute, modify, transmit, or create derivative works based on the Content without UCC’s prior written consent.

II. Limited License

UCC grants you a limited, revocable, non-exclusive, non-transferable license to access and view the Content on the Website for your personal, non-commercial use only. This license does not grant you any ownership or intellectual property rights in the Content or the Website.

III. Prohibited Uses

Without limiting the generality of the foregoing, you may not:

1. Reproduce, distribute, modify, transmit, or create derivative works based on the Content, except as expressly permitted under this Copyright Policy or by applicable law.

2. Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Content.

3. Circumvent or attempt to circumvent any security measures or access controls implemented on the Website or the Content.

4. Use the Content for commercial purposes or in any manner that may be considered defamatory, obscene, threatening, infringing, or otherwise unlawful.

5. Scrape, crawl, or otherwise collect or harvest any Content or information from the Website using automated means, except as expressly permitted by UCC or by applicable law.

IV. Fair Use and Other Exceptions

UCC acknowledges and respects the principles of fair use and other exceptions to copyright law. If you wish to use any Content in a manner that may qualify as fair use or under another exception to copyright law, please contact UCC in advance to obtain written permission.

V. Digital Millennium Copyright Act (DMCA) Notice and Takedown Procedures

UCC respects the intellectual property rights of others and expects its users to do the same. If you believe that your copyrighted work has been copied and is accessible on the Website in a way that constitutes copyright infringement, you may notify UCC’s designated DMCA agent by providing the following information:

1. A physical or electronic signature of the person authorized to act on behalf of the owner of the copyrighted work.

2. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.

3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and information reasonably sufficient to permit UCC to locate the material.

4. Information reasonably sufficient to permit UCC to contact you, such as an address, telephone number, and, if available, an email address.

5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

UCC’s designated DMCA agent for notice of claimed infringement can be reached at: [email protected]

Upon receiving a properly submitted DMCA notification, UCC will promptly remove or disable access to the allegedly infringing material and notify the user who provided the allegedly infringing material. If the affected user believes that the removal or disabling of access to the material was done by mistake or misidentification, they may submit a counter-notification to UCC’s DMCA agent, including the following information:

1. A physical or electronic signature of the user.

2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

3. A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

4. The user’s name, address, and telephone number, and a statement that the user consents to the jurisdiction of the Federal District Court for the judicial district in which the user’s address is located, or if the user’s address is outside of the United States, for any judicial district in which UCC may be found, and that the user will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

Upon receiving a properly submitted counter-notification, UCC will promptly provide the complaining party with a copy of the counter-notification and inform them that UCC will replace the removed material or cease disabling access to it in 10 business days. UCC will replace the removed material or cease disabling access to it not less than 10, nor more than 14, business days following receipt of the counter-notice, unless UCC’s designated DMCA agent first receives notice from the complaining party that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on UCC’s system or network.

VI. Termination of Access

UCC reserves the right, in its sole discretion, to terminate or suspend your access to the Website and the Content for any reason, including but not limited to your violation of this Copyright Policy or any other terms and conditions governing the use of the Website.

VII. Modifications

UCC reserves the right to modify or update this Copyright Policy at any time without prior notice. Any changes to this Copyright Policy will be effective immediately upon posting on the Website. Your continued use of the Website after any such modifications or updates constitutes your acceptance of the revised Copyright Policy.
